The BJP welcomes the Sessions Court order for reopening the case against Shri Jagdish Tytler. Shri Jagdish Tytler is a permanent invitee to the Congress Working Committee and holding independent charge of the AICC Website. He contested elections in 2004 and was again chosen to contest in 2009 too, however due to public protest had to withdraw from the contest.

More than 2700 Sikh women, children and men were killed, some burned alive.  As observed by many eye witnesses, mobs on rampage led by congress leaders hung burning tyres around the neck of Sikh victims – many of whom still remain unpunished.

The Nanavati Commission observed, “…recorded evidences…indicate that local Congress leaders and workers had either incited or helped the mobs in attacking the Sikhs".

Congress Party has consistently used every trick to cover up the active complicity of its leaders and workers in perpetrating this massacre. Witnesses were threatened and victims were stopped from filing cases in police stations. Colluding with some unscrupulous elements in the police, congress men indulged in large scale effacing of evidences.

Nanavati Commission concluded that there was a colossal failure of law and order and held the head of the police force responsible. The Kapur Mittal Committee indicted 72 police officials, while the Jain Aggarwal Committee indicted 90 officials. They recommended the immediate dismissal of 30 officers too.

It is alleged that the Congress party worked on the cover-ups and delayed the process of departmental action knowing very well that no officer or government employee can be prosecuted from four years after their retirement.

Nanavati Commission observed that despite the curfew, mobs indulging in violence were moving freely and committing acts of looting and killing.

Justice Ranganath Mishra Commission blamed the Delhi Administration for the inordinate delay in calling the Army. Although adequate force was available in Delhi, in some areas not till the 3rd day after the riots began and in some other areas till the 4th day army was deployed.

The Congress party ensured even banning of publications which were raising questions about the cover ups.

Misuse of CBI was evident all the while. The Ranganath Mishra Commission also observed that wherever victims and witnesses named political leaders or police officers cases were not registered. Congress workers used pressure tactics on CBI to save their leaders at all levels. Media reports showed how in 1990 based on recommendations from the Potti-Roza Committee recommendations, a CBI team went to interrogate and file charges against Sajjan Kumar, a Congress leader. Sajjan Kumar’s supporters had threatened and locked them up. Unfortunately this Committee was disbanded.

Several Commissions have found, throughout the rioting the Dehi Police "remained passive and did not provide protection to the people.”

The CBI was misused also to file a misleading report to the Court which allegedly led to the dismissal of the case against Tytler, once earlier, at the Additional Chief Metropolitan Magistrate’s Court.

The CBI failed to comply with the order of a magistrate Court to examine eye witnesses.

Two crucial eye witnesses, Shri Jasbir Singh and Shri Surinder Singh, now living in New York have accused the CBI of not conducting a free and fair trial.They suspected that this was in order to protect Tytler. In December 2008, the CBI sent a team to New York to record their statements.

Notwithstanding, the CBI in March 2009, gave a clean chit to Tytler. Opposition parties and several Sikh bodies protested against this outrage. It is mention-worthy that the chief who gave the clean chit today is rewarded for his service with a gubernatorial post.

That there were very many other Congress leaders who were accused of perpetrating this sponsored massacre has is evident from the various Commissions and Committees which named Late. HKL Bhagat, Dharam Das Shastri, Sajjan Kumar, Kamal nath and Jagdish Tytler. It is relevant here to mention that a civil suit was filed in the United States District Court for the Southern District of New York. On 23rd January, 2013 in the State of Grison in Switzerland a case is filed against Shri Kamal Nath.

The BJP welcomes the order of the Court to reopen the case against Tytler.
