I had raised the issue of the 'Likelihood of Bias' by Shri Navin Chawla, Election Commissioner on account of his proximity with the Congress Party. The charge was further substantiated due to the receipt of MPLADS grant by Shri Chawla's family trusts from various Congress MPs.

Shri Navin Chawla in his statement had earlier alleged that Shri Sahib Singh Verma, MP from BJP had offered him a grant for the 'Jasola' trust run by his wife but the same could not be utilised since Shri Verma was not an MP from the area. Shri Chawla's false claim was apparent from the fact that Shri Verma was an MP from Outer Delhi and Jasola was a part of the Outer Delhi constituency.

Today, 'The Hindu' has put out a news item alleging that my wife had also made a donation to Mrs Rupika Chawla's Trust. Two figures of Rs. 13000/- and Rs. 28,.000/- have been alleged to have been made.

The true facts that I have ascertained are:

1) Mrs. Rupika Chawla is a business person who has been selling Art objects and even restoring them. Currently two of our paintings are with her for restoring the same.

2) In 2002 when Shri Navin Chawla was posted in Pondicherry Mrs Rupika Chawla was purchasing some antique look-alike furniture from Pondicherry and selling it in Delhi. The furniture was displayed in a Basement in Defence Colony.

3) My wife was offered some furniture for sale. My wife and her sister had visited the Defence Colony Basement and purchased some pieces of furniture for which my wife paid Rs. 13,000- and her sister who otherwise lives in Mumbai paid Rs. 28000/-. Both of them paid by cheque. The cheques were issued in the name of the entity informed to them by Mrs. Rupika Chawla.

4) It appears that instead of disclosing these receipts as one for sale of furniture, and paying taxes against the income accrued the Chawla's have fraudulently shown the sale consideration as donations from the buyers. This unilateral stand the throws up several questions which the Chawla's must answer:-

    a) Is Mrs Chawla involved in the business of sale and restoration of Art and Art furniture at any point of time?

    b) Has she not sold furnitre pieces bought from Pondicherry from a basement in Defence Colony?

    c) Isn't she liable to show the sale consideration for furniture in the Tax Returns? Instead she has chosen to evade taxes and shown it as a donation and claimed Tax exemption?

    d) Why should any one give donations for odd amounts such as Rs. 13000/- and Rs. 28000/-? Why should my wife's sister give any donation to a person whom she does not know?

So far the allegation against Shri Navin Chawla has been of political impartiality, he has now chosen to be too clever by halves. His strategy of leaking out information can only back fire. Are the trusts controlled by him and his family earning a corpus due to Tax evasion? This issue involves a Tax fraud. It is an issue of moral turpitude. How can someone involved in this exercise be the holder of such a sacrosanct constitutional office. I will be independently writing to the Chairman of the Central Board of Direct Taxes to inquire if sale consideration for sale of furniture purchased by unsuspecting buyers is being passed off as a Charitable donation entitling him and his family members to claim tax exemptions.
