Assam BJP leader Shri Charn Chandra Deka has filed writ petition in the Supreme Court challenging the amendment made by the Central Government in Foreigners Order 1964. The petitioner demanded complete withdrawal of the government order of 10th February, 2006, whereby the onus to proof in the matter of foreign citizens has been put on the complainant or the state. Earlier the onus to proof in the foreigners act was on the person whose citizenship was challenged.

The IMDT act has this provisions whereby the onus to proof was put on the complainant or on the state. The act was scrapped by the Honorable Supreme Court, saying that it was violative of article 14 and article 355. The Supreme Court has also observed that, IMDT instead of deporting foreigners practically helped them stay in the country. The Supreme Court also observed that such illegal immigration was nothing but a sort of silent aggression.

The petitioner Shri Deka has said that the amendment to the foreigners tribunal order No. 1964 is done with political motive and just to appease a particular vote bank on the eve of Aasam Elections. Instead of deporting the foreigners the Government of India has given infiltrators a blanket permit to stay in India. These amendments are against the letter and spirit of the order of the Supreme Court.

This amounts to contempt of the Supreme Court judgment. The first hearing of the petition is likely to be held on Friday.
