Subject: (WEST BENGAL) Widespread incidents of violence, voter intimidation and rigging during Fourth Phase Polls today

Sir,

As the polling in the fourth phase of elections is continuing, widespread violence has been reported and in particular the following locations have been badly affected as per the latest reports.

  1. Ketugram (Bolpur Lok Sabha Constituency): A certain individual is seen interfering with free and fair exercise of votes within the polling booths (namely booth nos. 104, 107) by going along with voters upto the EVM enclosure (shown live on Bengali media news channels – Video annexed). This goes against the norm that every vote is a secret ballot. This is putting undue pressure on the voter to cast his / her vote in favour of TMC. In the video it has also been seen that a Central force officer is merely watching this shocking incident from outside the booth, and not taking any preventive measures.

  1. In Jemua (Durgapur Lok Sabha Constituency) voters have been lathicharged by the police present there and chased away from polling booth. (Video annexed)

  1. In Barabani (Asansol Lok Sabha Constituency) Hon'ble MP Sh. Babul Supriyo was heckled outside the polling booth no. 199 and his car attacked. The window pane has been shattered.   BJP polling agents were refused entry into the booth.

  1. Chapra (Krishnanagar Lok Sabha Constituency): BJP workers are being terrorized and booth rigging is ongoing by Trinamool Congress at booth no. 145 Kalyandaha.

  1. Raniganj (Asansol Lok Sabha Constituency): Booth Nos. 169, 113, 218 have captured by the TMC cadre.

  1. Nalhati (Birbhum Lok Sabha Constituency): BJP workers and polling agents have been prevented from reaching the polling booths and attacked brutally.

  1. It has been reported that a group of 450 outsiders are planning to disturb polling process at Bahrampur Lok Sabha Constituencies. The specific locations have been identified namely Kandi, Beldanga, Reginagar, Saktipur, Sompara, Barawa and Salar

  1. In Padui (Bolpur Lok Sabha Constituency) BJP workers have been attacked outside Booth No. 30.

The Commission is requested to take effective steps to curb the violence and empower the Central Armed forces wherever deployed to take effective action to bring the situation under control.

Yours Sincerely

Mukhtar Abbas Naqvi                                           Vijay Goel

Sub:     Complaint against Repeated Violations of The Representation of The People Act 1951 and Model Code of Conduct by Sh. Rahul Gandhi

Sirs,

            We wish to invite the Commissions’ attention to the repeated and persistent violations of Model Code of Conduct by Shri Rahul Gandhi, President of Indian National Congress.

            The specific instances of brazen, baseless, malicious and defamatory allegations against Sh. Narendra Modi and Sh Amit Shah are as follows;

  1. On 29th March 2019 in his rally at Jagadhari, Yamunanagar, Haryana, Shri Rahul Gandhi stated;

  1. On the 10th of April, he deliberately and mischievously misquoted the Supreme Court of India and stated;

In a contempt petition filed in the Supreme Court of India, Shri Rahul Gandhi has accepted before the Supreme Court that his statement is false and he expressed “regret” over his false statement.

  1. While addressing a rally at Kolar, Karnataka on 13th April 2019, he stated as under:

  1. On 15th April 2019, while addressing a rally in Mahuva in Gujarat, he stated;

“….. His work is to snatch your water, electricity and land and give it these 15-20 industrialists…..”[English translation]

  1. In a public rally on 22nd April 2019 at Jabalpur, he stated;

He further went on to accuse Shri Amit Shah of being a ‘Murder Accused’ and attack his family members, who have nothing to do with politics. A detailed representation in this behalf, together with judgment of the court and other supports, has already been submitted to the ECI vide our letter dated 27th April 2019. [copy enclosed]

  1. It was followed up by INC’s press conference as reported in Amar Ujala on 24th April and it says;

In making references to Sh. Jay Shah, Shri Rahul Gandhi violated the model code which clearly states;

Criticism of other political parties, when made, shall be confined to their policies and programme, past record and work. Parties and Candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties. Criticism of other parties or their workers based on unverified allegations or distortion shall be avoided.

            The aforesaid are but just a few instances of brazen, blatant and utterly false and unverified and unsubstantiated allegations of Sh. Rahul Gandhi. There is a pattern and design and it continues unchecked and unabated.

            The matter that should concern the Election Commission is that will he and his cohorts continue, unabashedly and shamelessly, to spread lies and tear into the Model Code of Conduct, that the commission has put together as a set of basic rules of the game.

            While Bharatiya Janata Party is capable of countering such false charges, it is the Commission who has to take a view on, as to whose writ shall run and what shall be the code that every party in the electoral fray shall follow. We seriously apprehend that if this goes unchecked by the Commission, its credibility in the public perception shall stand seriously dented.

            While we have brought such instances to the notice of the commission from time to time, we had also hoped that the Electoral Officers of the states would take suo moto cognizance and take affirmative actions to stop these senseless accusations. In any case, we are yet to see any action, whatsoever, against the wilful defaulters who have so audaciously based their entire electoral campaign on a bunch of lies right under the watchful vigil of the Commission.

            We request the Commission to take immediate action against spread of falsehoods and violation of election code and Model Code of Conduct.

Regards

Mukhtar Abbas Naqvi                          Vijay Goyal                                     Anil Baluni

Sub:    Madhya Pradesh Elections – Appointment of State Level General Observer & Police Observers

Sir,

Bharatiya Janata Party had represented before the Election Commission that the partisan attitude of State Chief Secretary and also that of DG Police was not conducive to the holding of Free & Fair elections in the state of Madhya Pradesh.

The conduct of DEO at Jabalpur in denying permission to Shri Narendra Modi to hold a public meeting at Gol Bazar at the behest of Shri Vivek Tankah, the congress candidate and the state chief secretary Shri SR Mohanty.

In yet another incident, the DEO at Chhindwara denied permission to the helicopter carrying Shri Shivraj Singh, former CM of MP to land & take off beyond 5PM. Apparently, this was wrongly denied and the campaign program of Shri Shivraj Singh was disturbed. Two days later, the same DEO permitted the landing of the helicopter carrying Shri Kamal Nath well beyond 5PM, as if no rules applied or applied differently. The matter was promptly reported to Election Commission at all levels, but sadly no corrective action was taken.

While DEO Chhindwara was clearly guilty of breach of protocols, rules and instructions of the ECI, he was only acting at the behest and prompting of senior officials in the state.

Such incidents; big and small are many. The two aforesaid incidents have been mentioned only a case in point.

The conduct of the Director General of Police has been not very different. Beholden to the CM, Shri Kamal Nath, in the case of income tax raids, he chose to side with the culprits and the accused rather than the law. Such acts need no further elaboration and confirm beyond doubt the personal commitment to Shri Kamal Nath, that these two senior officials have demonstrated.

We had clearly brought out the nexus between the two in so much as that Shri Tankha had represented Shri Mohanty, free of cost, at various stages of litigation including at the supreme court level. The appointment of Shri Mohanty, understandably, is on the condition that he will ‘assist’ the state government headed by Shri Kamal Nath in ‘all manners’.

We also refer to our detailed memorandums on the subject and request the Commission that a Special State Observer as well as Special State Police Observer be appointed forthwith to inspire confidence, ensure transparency and ensure a level playing field.

With regards,
