BJP MahilaMorcha Thanks Hon’ble Prime Minister Shri Narendra Modi Ji for Historical Decision on Domicile Policy that will Benefit Women of Jammu and Kashmir Union Territory
BJP MahilaMorcha wholeheartedly thanks Hon’ble Prime Minister Shri Narendra Modi Ji for the historic decision that will benefit scores of women of Jammu and Kashmir Union Territory with DomicleRights that were denied to them for decades.
A pre-Independence, monarchy-era policy that granted Permanent Resident status to only those who were State subjects as on May 14th, 1954, that was protected by the now revoked Article 35A of the Constitution of India, has been done away with by Hon’ble Prime Minister Shri Narendra Modi Ji’s government.
Earlier, only Permanent Residents were eligible for employment in the erstwhile State government, for reservations in the public sector, for admission to State-run professional institutions, and to own property in the State.
Non-Permanent Residents were also denied the right of representation in the State and the local body governance. They could vote in Parliament elections but could not vote or contest in elections to the Legislative Assembly or the Panchayats.
The old Permanent Resident rule/law was discriminatory against the women of Jammu & Kashmir as it disqualified them from the State subject’s rights if they married non-permanent resident.
But the new Domicile Policy does justice to the women of Jammu & Kashmir, since it gives them freedom of marriage and to retain theirDomicile, as also to exercise their rights of equal participation in Society. As well their spouses are also entitle to get the benefit under the domicile policy.
