Bharatiya Janata Party National Spokesperson Shri Gaurav Bhatia convened a press conference at the party's central office on Wednesday. During the press conference, Shri Bhatia accused Mamata Banerjee of protecting the criminals involved in the heinous crime of rape and murder of a postgraduate trainee doctor in the State of West Bengal, which led to the High Court's decision to transfer the investigation to the CBI. Shri Bhatia highlighted that the failure to register an FIR, the delay in showing the victim's body to her family, and the protection of the College Principal indicate the involvement of Mamata Banerjee's government in the case.

 

Shri Bhatia stated that in Kolkata, a PG trainee doctor was probably gang-raped and brutally murdered. He noted that the recent Calcutta High Court verdict is deeply concerning, highlighting the collapse of law and order in West Bengal. ‘Nir-Mamata Banerjee’ needs to answer several questions, as women in West Bengal and across India want to know why, when Mamata Banerjee should have stood with the victim's family, she was instead busy safeguarding the culprits. The Calcutta High Court's observation has exposed the "Jungle Raj" under Mamata Banerjee's leadership.

 

BJP National Spokesperson Shri Bhatia stated that the petitioners in the case are the deceased victim’s parents, who are seeking justice from Mamata Banerjee. However, instead of addressing their concerns, she appears indifferent to the plight of the grieving parents. Serious questions are being raised about the governance under 'Nir-Mamata Banerjee.' The Calcutta High Court has transferred the Kolkata rape and murder case to the CBI, but the crucial question remains, under what conditions or circumstances did the need arise to involve the CBI in this case?

 

Shri Bhatia stated that after reviewing the judgment and various media reports, it is evident that Mamata Banerjee might be attempting to protect certain individuals. He questioned who these individuals are and why they were being shielded. He pointed out, that the first 48 hours after a crime are crucial for understanding the crime scene and conducting a thorough forensic investigation. However, instead of acting promptly, Mamata Banerjee delayed the transfer of the case to the CBI by several days. Mamata Banerjee needs to explain why she delayed handing over the case to the CBI and why she did not immediately transfer it to ensure a proper investigation of the crime scene. She should also address why the investigation was not conducted fairly. The delay in Mamata Banerjee’s action has led to the tampering and destruction of evidence.

 

BJP National Spokesperson Shri Bhatia highlighted several points, questioning the actions of the state government under Mamata Banerjee's leadership. He emphasized that in cases of heinous crimes, registering an FIR is mandatory by law. He cited the Supreme Court's ruling in the Lalita Kumari case, which clearly states that a police officer is obligated to file an FIR when a cognizable or heinous offense occurs.

 

Shri Bhatia emphasized that the troubling aspect is that no FIR was filed, the police only labeled it as an unnatural death. The victim's family has argued in court that they received a phone call earlier informing them that their daughter, who had spoken to her parents the night before, was unwell. It is important to uncover how Mamata Banerjee conspired to cover up the case and protect the culprit.

 

BJP National Spokesperson Shri Bhatia mentioned that Paragraph 13 states: "The parents would state that at about 10:53 am on August 10th, 2024, they received a call from the hospital authorities. The assistant superintendent of Kar Medical College Hospital informed them that their daughter was unwell." Shortly after, at 11:15 am, the same assistant superintendent claimed that their daughter had committed suicide. This conclusion was reached in just 22 minutes. Given that it was widely known the girl had been sexually assaulted and her body was still at the crime scene, why was this new story being fabricated? Subsequently, a protest erupted. It raises the question of why the victim's parents were forced to wait for three hours and were not allowed to see their daughter's body. If this isn’t ‘Nir-Mamata Banerjee', then what is?

 

Shri Bhatia stated that an FIR should have been registered immediately, it was the principal’s responsibility to ensure this. Instead, no FIR was filed, and the case was classified as an unnatural death. The principal, who was supposed to ensure the safety of women, doctors, and citizens at the government medical college and hospital, was involved in destroying evidence. Rather than taking action and suspending the principal, the Mamata Banerjee government transferred him to another government medical college in Kolkata.

 

BJP National Spokesperson Shri Bhatia cited that the High Court remarked, "The appropriate authority of the state government should consider the circumstances leading to the resignation. Therefore, even if the resignation was not accepted, the least that can be expected from a responsible higher official of the concerned department is to immediately relieve the principal of his duties and not assign them any duties of equal responsibility.

 

Shri Bhatia criticized Mamata Banerjee, accusing her of siding with the accused principal rather than the victim’s family. He expressed concern that the accused remains free while important evidence has been destroyed, noting that renovation work was suddenly carried out at the crime scene, possibly to cover up crucial evidence. Shri Bhatia emphasized that the most significant aspect of the Calcutta High Court's judgment was the transfer of the investigation to the CBI to restore public confidence. The High Court acknowledged the urgency of the matter, stating that the case's peculiar circumstances warranted immediate action, as any delay could compromise evidence and allow the culprits to escape justice. He thanked the Calcutta High Court for ensuring a promising path to justice and expressed confidence that the CBI would conduct a thorough investigation, leading to the capture and punishment of the culprits. He reiterated the importance of swift action in preserving evidence and ensuring justice for the victim’s family.

 

BJP National Spokesperson Shri Bhatia highlighted that the handling of the case is similar to the Sandeshkhali incident, where Mamata Banerjee protected Shahjahan Sheikh. In that case, it took 55 days and the intervention of the Calcutta High Court for Shahjahan Sheikh to be arrested. Similarly, after the May 2 incident, where women were killed following the announcement of the Vidhan Sabha results, the Calcutta High Court observed that no FIRs had been registered in connection with the violence.

 

Shri Bhatia emphasized that to ensure a fair investigation, the court had to intervene and transfer the case to the Vivechana unit. These incidents suggest that Mamata Banerjee's governance is compromised, with attempts to destroy evidence within crucial time frames. Furthermore, Shri Bhatia raised concerns that the victim's family was prevented from seeing their daughter's body for three hours, leading them to lose faith in the state government. He also criticized the swift reassignment of the college principal, who should have been expelled but instead received a plum posting within 12 hours. He questioned why Mamata Banerjee announced on August 10 that she would hand over the case to the CBI only after a few days, further delaying justice.

 

National Spokesperson Shri Bhatia questioned the insensitivity of Mamata Banerjee, emphasizing that the first 48 hours were crucial for collecting evidence, conducting forensic examinations, and ensuring an unbiased post-mortem. However, this did not happen. As long as Mamata Banerjee remains the Chief Minister, no woman in West Bengal will feel safe. It was Mamata Banerjee's moral duty to resign after the incident to prevent further crimes like murder or rape in the state. The entire state of Bengal is seeking justice.

 

BJP National Spokesperson Shri Bhatia stated that as a responsible political party, the Bharatiya Janata Party has raised these issues because this incident is like Nirbhaya 2 and has deeply shocked the nation. The BJP stands firmly with the family of the deceased and will leave no stone unturned to ensure effective, speedy justice for the family members of the deceased. The BJP will make every effort to hold those responsible for the crime accountable, even if it means pursuing the strictest possible punishment, including the death sentence. This is our duty and obligation to every citizen of the country, especially those in West Bengal.
