Bharatiya Janata Party condemns Justice U C Banerjee committee report as absurd, illogical and politically motivated. BJP regrets that a senior judge has lent himself for political maneuvering. BJP is confident that UPA's plan to use this report in ensuing elections will fall flat.

First, the Gujarat High Court has passed a stay order and while concluding the hearing in this matter said that the final judgment will be passed on the 7th March. The High Court was intending to pass an operative order on First March but deferred after the advocate for Banerjee Committee assured the Court that nothing will happen till 7th March. Hence the submission and publication of the report in intervening period amounts to fraud on judicial process.

Second, the political design is badly exposed. The interim report was submitted and published on the eve of Bihar Assembly election in Feb, 2005. Now the final report is also submitted and published after the notification is issued for Assembly elections in five states.

Third, the Godhra carnage is already under consideration of the Nanavati Commission, the High Court and the Supreme Court and as such a separate committee was unnecessary but was constituted with the political motive. Therefore the committee report has no legal basis.

Fourth, there are enough proofs to show that organised mob was present on the site, diesel and petrol stock was piled up before the incidence and fire brigade rescue mission was obstructed by unruly mob, which had gathered outside. The Supreme Court has rejected the bail applications of all the accused on the basis of these proofs. The POTA tribunal also has confirmed the continuation of their detention. Thus the Banerjee committee findings do not tally with the facts presented before the Courts.

No one will buy Banerjee Committee argument of accident as if suggesting that passengers instead of fleeing the burning compartment committed a mass suicide. Banerjee Committe's argument that train was not running, no mob was outside, or any bomb explosion took inside the compartment, doesn't give any credibility that 59 Kar Sevaks were burned to death and could not come out of the compartment. This report is not only absurd and illogical but adds insult to the injury.
