Minister of State, Uttar Pradesh Government and BJP leader Shri Asim Arun addressed a press conference at the party’s headquarters in New Delhi on Wednesday. Shri Arun highlighted Congress's numerous attempts to alter the basic structure of the constitution, while emphasizing that the Bharatiya Janata Party has pursued constitutional amendments sparingly, focusing on bolstering various facets to advance social justice.

 

Shri Arun stated that under the leadership of Shri Narendra Modi, the BJP is working on every task that strengthens the constitution. Dr. Bhimrao Ambedkar created the constitution as a fortress, which is referred to as the basic structure of the constitution, and no one has the right to change it. The right to change the furniture inside this fortress is indeed within the constitution, and the BJP has made very positive use of it. The most recent amendment proposed by the BJP, known as the "Nari Shakti Vandan Bill," has expanded reservation provisions. Initially devised by Baba Sahab to aid historically marginalized communities like Scheduled Castes and Scheduled Tribes, the BJP-backed administration has extended its scope to include Other Backward Classes (OBCs). Additionally, Hon'ble Prime Minister Shri Narendra Modi commenced the provision of reservations for the Economically Weaker Sections (EWS) several years prior to 2019, a move that was effectively put into action. The implementation of one-third reservation for women in Parliament and state legislatures is a constitutional amendment initiated by the Bharatiya Janata Party. This amendment strengthens the constitution and advances the cause of social justice by promoting the vision of Dr. Bhimrao Ambedkar. It beautifully illustrates how social justice is fostered through such reservation provisions. On the contrary, the most significant attempt to alter the constitution was made by late Indira Gandhi. When she was deemed ineligible by the High Court in a case, and her position as Prime Minister was at risk, she introduced an amendment to the constitution. In this amendment, it was stated that the Supreme Court or any judiciary body would not have the authority to hear petitions challenging the elections of the Prime Minister, President, Vice President, or Speaker. Congress made numerous attempts, but this was a notable effort where an attempt was made by Congress to alter the basic structure of the constitution. The power of the judiciary is commendable, as they struck down this amendment, and then Indira Gandhi declared an emergency to safeguard herself. The most serious attempt to amend the constitution and the most severe consequences of undermining it were carried out by the Congress party. The Bharatiya Janata Party has consistently pursued constitutional amendments only when deemed absolutely necessary, making fewer changes compared to other parties. However, each proposed amendment by the Bharatiya Janata Party has been geared towards bolstering different facets, thus advancing the path towards social justice.

 

BJP Leader Shri Arun underscored the unalterable nature of the Constitution's fundamental structure, encompassing its core principles of social justice and reservation. The positive aftermath of Article 370's abrogation in Kashmir, facilitating the implementation of previously obstructed reservations. Expressing concern, he criticized the Congress's proposal to revive Article 370, cautioning against potential setbacks to the progress achieved in extending justice to marginalized communities. Furthermore, The efforts in selected southern states to manipulate constitutional provisions, seeking to reallocate reservations designated for SC, ST, and OBC groups to the Muslim community. During the constitutional assembly discussions on how to amend Article 368, Jawahar Lal Nehru suggested that it should be flexible to allow changes to the Constitution. However, Babasaheb's draft proposed that for such amendments, a two-thirds majority and the consent of the states were necessary. This arrangement, devised by Babasaheb, is revered by all of us, not only for his principles but also from a practical standpoint. The BJP is committed to safeguarding it.
