Sub:    Complaint against Repeated, Intentional and Brazen Violations of The Representation of The People Act 1951 and Model Code of Conduct by Sh. Rahul Gandhi.

Ref: Our letter no. BJP/ECC/19/23 dated 12.04.19 and Letter no. BJP/ECC/19/69 dated 29.04.2019

Sir,

            We wish to draw the Commissions’ attention to the repeated and persistent violations of Model Code of Conduct by Shri Rahul Gandhi, President, Indian National Congress. At the outset, it regretfully seems that the Commission has given ‘free hand’ to the direct, baseless, malicious and defamatory allegations by Sh. Rahul Gandhi against the Hon’ble Prime Minister Sh. Narendra Modi and Sh. Amit Shah, National President, BJP. Sh. Gandhi has been entrenched as such that, since the enforcement of the MCC from 10.03.2019, 11 cases of serious violation of Model Code and the Representation of the Peoples Act, 1951 has been filed. To our despair, only in one case he has been issued a show-cause notice, whereas in another, to our utter shock and surprise, a clean chit has been granted. It is pertinent to mention herein that, we have already filed a letter dated 04.05.2019 with the Commission to provide us with the transcripts of the DEO, Jabalpur, on the basis of which the decision was arrived at, so that appropriate application for revision could be made.

            The specific instances of intentional, repetitive, baseless, malicious and defamatory allegations against Sh. Narendra Modi and Sh Amit Shah are as follows:

  1. That in the complaint dated 13.03.2019, we had clearly highlighted the violations of MCC & other electoral laws done by Shri Rahul Gandhi during his rally in Ahmedabad, Gujarat on 12th March 2019. An extract of his speech is reproduced herein as below:
  • नरेंद्र मोदी देश को यह नहीं बतातें की वायु सेना की जेब से ३०००० करोड़ रुपये चोरी कर के अनिल अम्बानी की जेब में डाला हैं
  • मोदी ने इंडियन एयर फाॅर्स का ३०००० करोड़ रुपये अनिल अम्बानी को दिए
  • राफेल जाँच होनी थी तब सीबीआई डायरेक्टर को हटा दिया
  • सरकार ने १५ लोगों को . लाख करोड़ का कर्जा माफ़ किया
  • देश के आम लोगों की जेब से पैसे निकालें और १५ लोगों को दे दिए
  • लोग इलाज करने के लिए जातें हैं और उनका पैसा भी १५ लोगों को दे दिया जाता हैं
  • बेरोजगार और किसानो को मदद नहीं किया

  1. That on 22.03.2019, Shri Rahul Gandhi tweeted, “BJP ke sare Chowkidar Chor Hai. NoMo Arun Jaitley Rajnath Singh.” (which can be accessed at https://twitter.com/RahulGandhi/status/1109054341049008129 )
  2. On 29th March 2019 in his rally at Jagadhari, Yamunanagar, Haryana, Shri Rahul Gandhi stated;

 “…..बीजेपी ने छोटे दुकानदारों, किसानों को कष्ट देने को काम किया है. मोदी जी स्टार्ट अप इंडिया, मेकइन इंडिया... जहां भी बात करते हैं इसी की बात करते हैं. लेकिन उन्होंने युवाओं के 30 हजार करोड़ रुपये छीनकर अनिल अबांनी के बैंक में डाल दिया.

बैंक की चाभी अनिल अंबानी, अडानी और नरेंद्र मोदी ने अपने हाथ में लेकर रखी है. मैं आपको कहता हूं कि हम नीरव मोदी, नरेंद्र मोदी के बैंक से पैसे लेकर आपके हाथ में दे देंगे.

प्रधान चौकीदार के सारे वादे झूठे हैं। इस गब्बर सिंह ने बहुत लूटा है।………”

  1. That in the complaint dated 09.04.2019, we objected to the unverified, false &  frivolous statements made against the Hon’ble Prime Minister by Shri Rahul Gandhi in public on 04.04.2019 in Wayanad, Kerala relating to defence deals. An extract of the same is reproduced herein as below:

“…the country had faith in the PM when he said I will be the chowkidar, and the fact of the matter is that the chowkidar himself has given Anil Ambani 30000 crores of air force money. He has stolen money and given it to Anil Ambani.”

  1. On the 10th of April, he deliberately and mischievously misquoted the Supreme Court of India and stated;

“....सुप्रीम कोर्ट ने माना है कि राफेल मामले में कोई कोई कमी रह गई .. और  कोई कोई भ्रष्टाचार हुआ है... मुझे बहुत खुशी हो रही है की जो मैं जो मैं महीनों से कह रहा हूं कि हिंदुस्तान के प्रधानमंत्री ने एयरफोर्स का पैसा चोरी करके अनिल अंबानी जी को दिया है... तीस हज़ार करोड़ रुपये दिये हैं... उस बात को आज सुप्रीम कोर्ट ने मान लिया है... और सुप्रीम कोर्ट इन्वेस्टीगेशन करने जा रहा है... मैं नरेंद्र मोदी जी को डिबेट के लिये चैलेंज कर रहा हूं कि नरेंद्र मोदी जी... सुप्रीम कोर्ट ने आपके बारे में कहा हैं कि आपने भ्रष्टाचार किया है... आपने अनिल अंबानी को तीस हज़ार करोड़ रुपये दिये हैं...देश राफेल मामले में जानना चाहता है... भ्रष्टाचार के बारे में जानना चाहता है... नोटबंदी के बारे में जानना चाहता है... मैं देश को बता रहा हूं कि राफेल मामले में खुल्लमखुला भ्रष्टाचार हुआ है... चौकिदार जी ने अनिल अंबानी जी को तीस हज़ार करोड़ रुपये दिये हैं... चौकिदार मुझसे डिबेट करना नहीं चाहते है... क्योंकि चौकिदार जी जानते हैं कि जिस दिन मेंरे साथ उन्होनें डिबेट कर दी भ्रष्टाचार पर वो हिंदुस्तान की आंख में आंख नहीं मिला पायेंगे... मैं फिर से सुप्रीम कोर्ट का धन्यवाद करना चाहता हूं ... पूरा देश कह रहा है कि चौकिदार ने चोरी की है और आज बहुत खुशी का दिन है कि सुप्रीम कोर्ट ने न्याय की बात की है... जस्टिस हैस प्रिवेल्ड ... सुप्रीम कोर्ट हैस सेड.. कि चौकिदार ने चोरी की है...”

In a contempt petition filed in the Supreme Court of India, Shri Rahul Gandhi has accepted before the Supreme Court that his statement is false and he expressed “regret” over his false statement.

  1. That in our representation dated 11.04.2019, we apprised the Election Commission about the baseless and mischievous allegations made by Shri Rahul Gandhi against the Hon’ble Prime Minister. His statement at Amethi, Uttar Pradesh on 10.04.2019 is reproduced herein as below:

नरेंद्र मोदीजी सुप्रीम कोर्ट ने आपके बारे में कहा है की आपने भ्रष्टाचार किया है आपने अनिल अम्बानी को 30000 करोड़ रूपये दिए ... की राफेल मामलें में खुल्लम खुल्ला भ्रष्टाचार हुआ है, चौकीदार जी ने अनिल अम्बानीजी को 30000 करोड़ रूपये दिए है I सुप्रीम कोर्ट हैज़ सेड चौकीदार ने चोरी की है ....... चौकीदार ने चोरी की है......”

  1. While addressing a rally at Kolar, Karnataka on 13th April 2019, he stated as under:

“… मेरा एक सवाल है।  सभी चोरो के नाम मोदी क्यों है चाहे वह नीरव मोदी हो, ललित मोदी हो या नरेंद्र मोदी ? हम नहीं जानते की कितने और मोदी सामने आएंगे।…”

  1. On 15th April 2019, while addressing a rally in Mahuva in Gujarat, he stated;

“….. His work is to snatch your water, electricity and land and give it these 15-20 industrialists…..”[English translation]

  1. In a public rally on 22nd April 2019 at Jabalpur, he stated;

“……….चौकीदार ने पांच लाख 55 हजार करोड़ करोड़ रुपये अपने 15 मित्रों को बांटे। नरेंद्र मोदी पहले कहते थे कि वह 15 लाख रुपये आम लोगों के बैंक खातों में डालेंगे। अब कहते हैं कि मैं तो पैसे अनिल अंबानी के खाते में डालूंगा।…….”

 

He further went on to accuse Shri Amit Shah of being a ‘Murder Accused’ and attack his family members, who have nothing to do with politics. A detailed representation in this behalf, together with judgment of the court and other supports, has already been submitted to the ECI vide our letter dated 27th April 2019. [copy enclosed]

  1. It was followed up by INC’s press conference as reported in Amar Ujala on 24th April and it says;

“ कांग्रेस अध्यक्ष राहुल गांधी ने मध्य प्रदेश के जबलपुर में मंगलवार को भाजपा अध्यक्ष अमित शाह पर तीखा हमला बोला। मंच से संबोधित करते हुए राहुल ने कहा कि हत्या के आरोपी भाजपा अध्यक्ष अमित शाह। वाह क्या शान है। क्या आपने कभी जय शाह का नाम सुना है, वह जादूगर हैं। तीन महीने में 50 हजार रुपये को 80 करोड़ बना दिया। इस दौरान उन्होंने एक बार भी जनता सेचौकीदार चोर हैके नारे लगवाए। 

चौकीदार चोरहमारा सियासी नारा, चलता रहेगा : कांग्रेस

कांग्रेस ने कहा है किचौकीदार चोर हैपार्टी का राजनीतिक स्लोगन है और उसे आगे भी जारी रखेगी। …….”

In making references to Sh. Jay Shah, Shri Rahul Gandhi violated the model code which clearly states;

“Criticism of other political parties, when made, shall be confined to their policies and programme, past record and work. Parties and Candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties. Criticism of other parties or their workers based on unverified allegations or distortion shall be avoided.

  1.  Despite stringent observation by the Hon’ble Supreme Court in the Contempt petition filed against Sh. Rahul Gandhi on 02.05.2019, he has shown open defiance in the press conference that was held on 04.05.2019 at the INC, Head Quarter at New Delhi. While Sh. Gandhi again with his intentional, repetitive and baseless allegations not only tried to malign the image of Sh. Narendra Modi but also clutched and maligned several constitutional institutions of the country. During the press conference he stated as under:

“…और फाइनल बात मैं आपको बता देता हु, राफेल मामले में चौकीदार ने 30,000 करोर रूपये चोरी किया है. ...अब आपलोग सवाल पूछते हो की मैंने सुप्रीम कोर्ट को apologise किया है, बिलकुल मैंने सुप्रेम कोर्ट को apologise किया है| मैं आपको बताता हु की क्यों किया, क्युकी सुप्रेम कोर्ट में प्रोसेस चल रही है, और मैंने उस प्रोसेस के बारे में कमेंट कर दी है, और वो मेरी जगह नहीं है |तोह मैंने apologise कर दिया| मगर चौकीदार चोर है, नारा है, चौकीदार चोर है सचाई है, और चौकीदार चोर है reality है |और मैं ना नरेंद्र मोदी से ना बीजेपी ना किसी और से apologise कर रहा हु | ...

 

            The aforesaid are but just a few instances of brazen, blatant and utterly false and unverified and unsubstantiated allegations of Sh. Rahul Gandhi. There is a pattern and design and it continues unchecked and unabated.

 

            The matter that should concern the Election Commission is that will he and his cohorts continue, unabashedly and shamelessly, to spread lies and tear into the Model Code of Conduct, that the commission has put together as a set of basic rules of the game.

 

            While Bharatiya Janata Party is capable of countering such false charges, it is the Commission who has to take a view on, as to whose writ shall run and what shall be the code that every party in the electoral fray shall follow. We seriously apprehend that if this goes unchecked by the Commission, its credibility in the public perception shall stand seriously dented.

 

            While we have brought such instances to the notice of the commission from time to time, we had also hoped that the Electoral Officers of the states would take suo moto cognizance and take affirmative actions to stop these senseless accusations. In any case, we are yet to see any action, whatsoever, against the wilful defaulters who have so audaciously based their entire electoral campaign on a bunch of lies right under the watchful vigil of the Commission.

            We request the Commission to take immediate action against spread of falsehoods and violation of election code and Model Code of Conduct.

SUB:               FOLLOW UP COMPLAINT AGAINST INDIAN NATIONAL CONGRESS FOR INDULGING IN CORRUPT PRACTICE IN ELECTIONS BY DISTRIBUTING PAMPHLETS CUM ENROLMENT FORMS TO ENROLL PEOPLE IN NYAY SCHEME AND VIOLATING MODEL CODE OF CONDUCT AND PROVISIONS OF REPRESENTATION OF THE PEOPLE ACT 1951

Sir,

  1. We write in continuation of our complaints dated 27.04.2019, 29.04.2019 and 03.05.2019 in which we brought to the notice of Election Commission the corrupt practices of Indian National Congress where the Party was distributing the pamphlets cum enrolment forms in various states to enroll people for Nyay Scheme promised by the Congress Party. Copies of the letter dated 27.04.2019, 29.04.2019 and 3.05.2019 are annexed herewith as ANNEXURE A

 

  1. Bhartiya Janata Party has once again come across the instances of Congress Party distributing the forms among people with a promise to pay Rs. 72000/- per year to those who vote for Congress Party.

 

  1. That these activities are being carried on Burari Vidhan Sabha which comes under North East constituency of Delhi. The videos being circulated on the social media clearly show Congress Party indulging in gross violation of Model Code of Conduct and provisions of Model Code of Conduct. It is further submitted that a police complaint was lodged in this regard and the police reached the on the spot so that this illegal activity could be stopped.

In addition to this acknowledgement, a pamphlet containing the following text is being distributed with the picture of Ms. Shield Dikshit

 

“…शीला दीक्षितविकास निश्चितगरीबी पर वार  … 72 हज़ार…”

  1. It is further submitted that the circulation of these forms is clearly an attempt by Indian National Congress to influence the voters by illegal means and in complete violation of the Model Code of Conduct and Section 123 of The Representation of The People Act 1951 which reads as under

123. Corrupt practices.—The following shall be deemed to be corrupt practices for the purposes of this Act:— 1[

(1) “Bribery”, that is to say—

(A) any gift, offer or promise by a candidate or his agent or by any other person with the consent of a candidate or his election agent of any gratification, to any person whomsoever, with the object, directly or indirectly of inducing—

(a) a person to stand or not to stand as, or 2[to withdraw or not to withdraw] from being a candidate at an election, or

(b) an elector to vote or refrain from voting at an election, or as a reward to—

(i) a person for having so stood or not stood, or for 3[having withdrawn or not having withdrawn] his candidature; or

(ii) an elector for having voted or refrained from voting;

(B) the receipt of, or agreement to receive, any gratification, whether as a motive or a reward—

(a) by a person for standing or not standing as, or for 4[withdrawing or not withdrawing] from being, a candidate; or

(b) by any person whomsoever for himself or any other person for voting or refraining from voting, or inducing or attempting to induce any elector to vote or refrain from voting, or any candidate 2[to withdraw or not to withdraw] his candidature. Explanation.—For the purposes of this clause the term “gratification” is not restricted to pecuniary gratifications or gratifications estimable in money and it includes all forms of entertainment and all forms of employment for reward but it does not include the payment of any expenses bona fide incurred at, or for the purpose of, any election and duly entered in the account of election expenses referred to in section 78.]

 

  1. We therefore request the Election Commission to:

 

    1. take cognizance of this issue and also launch an immediate probe in the matter
    2. issue direction to CEO of Delhi to immediately take action to stop such attempts to influence voters
    3. issue an advisory on the same to the voters and take strict action against those distorting the level playing field in the elections

Subject: (WEST BENGAL) Smt. Mamata Banerjee, Hon’ble Chief Minister threatening BJP voters to beware once elections get over; terming “Jai Shree Ram” chant as an abuse; and falsely remarking that the BJP runs a parallel government through the Election Commission of India

 

Sirs,

We would like to bring to your attention three issues concerning the recent conduct of Smt. Mamata Banerjee, Chairperson of the Trinamool Congress

I.

Smt. Mamata Banerjee, Hon’ble Chief Minister of West Bengal and Chairperson of the Trinamool Congress’s campaign has been full of threats, intimidation and call for violence against the Bharatiya Janata Party, its workers and leaders. The consequences are evident from the large scale violence that has been reported from the five phases of polling completed till now in West Bengal.

In a latest video of two days ago, Smt. Mamata Banerjee is seen openly threatening BJP voters to beware after elections as they will have to remain in Bengal under her Government in power, and that voters should vote only for TMC if they wish to ensure their own personal safety after the elections. The English translation of the whole video is as follows: 

“A political party- minimum courtesy is expected from it. I was coming through Chandrakona Road. In some places some of their monkeys. I don't refer to them as anything but monkeys. Because they are not in politics. They have been bought a few of them with money and having taken money they are resorting to all kinds of comments and abusive language. I am saying that election will be over after few days. After that everyone has to live in Bengal properly. Keep that in mind. Don't show your rage (LOUD CHEERS…) Don’t show your rage (IN BENGALI: BESHI GOROM DEKHIYO NA). It is unbecoming. You and I will both have political fight. You will have your say and I will have mine. but remember, if you surround my car and stand in front of my car and abuse, and if I tell my workers to take revenge, you know what will happen. I don’t want that. Because we allow good behavior...” In your culture, there is no place for good behaviour. We think this is our state. we have learnt good behaviour, culture, everything...”

It is a blatant violation of the Model Code of Conduct that says:”All parties and candidates shall avoid scrupulously all activities which are “corrupt practices” and offences under the election law, such as bribing of voters, intimidation of voters …”

The same also amounts to a “corrupt practice” under Section 123(2)(a)(i) of the Representation of People Act, 1951 since it interferes with the free exercise of electoral right of an elector by asking the elector to vote for a particular political party or else face consequences endangering their own personal safety. This also amount to the offence of undue influence at elections under Section 171C of the Indian Penal Code, 1860.

  

II.

The above statement of Smt. Mamata Banerjee, Chairperson of the Trinamool Congress was made in reference to an incident that occurred on Sunday i.e. 5.5.19 at Ghatal Lok Sabha Constituency when Smt. Banerjee got off her vehicle and charged at the local villagers who were heard shouting “JAI SHREE RAM” chants. Smt. Banerjee termed these chants as an “ABUSE”. In the said video she is heard saying “Why are you running away come here why are you running away…..You are abusing me”  This remark of the Chief Minister has shocked the people of India and is a blatant dereliction of the Model Code of Conduct namely:

“No party or candidate shall include in any activity which may aggravate existing differences or create mutual hatred or cause tension between different castes and communities, religious or linguistic”      

Three people were also reportedly detained for chanting these slogans. III.

The Hon’ble Chief Minister of West Bengal has been repeatedly heard in her public rallies and in media interviews saying that the Bharatiya Janata Party is running a parallel government through the Election Commission of India. We condemn these false and highly misleading remarks. The video from the said media interview of the Hon’ble Chief Minister of West Bengal at Midnapore making these remarks is enclosed herewith marked as Annexure 5.   

It is an unequivocal trend seen recently that Smt. Mamata Banerjee, the Hon’ble Chief Minister of West Bengal and Chairperson of the Trinamool Congress has no regard for constitutional institutions and their autonomy or independence. In February this year, officers of the Central Bureau of Investigation were arrested by the local police in Kolkata at the behest of the Hon’ble Chief Minister of West Bengal. Moreover Smt. Mamata Banerjee has been repeatedly heard saying that the Central Forces deployed in the State are BJP agents. 

To brand the Election Commission as an agent of a political party is grossly sacrilegious to the Constitution of India and our democracy. A Chief Minister is expected to adhere and maintain allegiance to the Constitution. By raising fingers at the Commission is not only discrediting the institution, but deliberately damaging its credibility in the eyes of the public.

We request the Election Commission to take strongest action against Smt. Mamata Banerjee as well as the Trinamool Congress. Such sneering remarks have been seen previously from other leaders of the Trinamool Congress namely Sh. Derek O’Brien, and no action on part of the Election Commission against such remarks has given impetus to the Trinamool Congress as well as other national and regional state parties like Indian National Congress (INC) to impinge the reputation of the Election Commission through their baseless charges against VVPATs and EVMs.

The Government of West Bengal has failed miserably to ensure law & order and a peaceful environment for holding free and fair elections in the State. This is clear from the way large scale incidents of violence have been reported during all the five polling phases until now. Voters have been attacked, our polling agents stopped from entering the polling stations, polling booths captured, voters impersonated by the Trinamool Congress cadre (chappa voting) etc.  The Trinamool Congress under the leadership of its Chairperson Smt. Mamata Banerjee, Hon’ble Chief Minister has tried its best to create disorder and an environment of fear to intimidate voters.  The Election Commission under Article 324 of the Constitution of India justly exercised its wide powers in order to ensure a safe and secure voting environment in West Bengal. 

We request that such mala fide and continuous efforts to create disorder, intimidate voters, create disharmony among different communities on caste and religious lines, and bring the Election Commission into disrepute must be brought to an end. The strongest action must be taken against Smt. Mamata Banerjee for her irresponsible conduct unbecoming of a Chairperson a political party that is everyday harming the democratic fabric of our nation and questioning the credibility of our country’s institutions.

Subject: (WEST BENGAL) Hurdles being created deliberately for Hon’ble Prime Minister’s Rally in Sainik School, Purulia on 9.5.2019

 

Sirs,

This is bring to your attention that the Principal Sainik School has already given us permission to use their Helipad vide their letter number SSP/101G dated 29.04 2019 addressed to DM Purulia with a copy marked to SP Purulia.

 

Subsequently on 5th May 2019 we have approached Principal ofSanik School for permission to hold a public meeting at their ground RaiBaghini Math on 09.05.2019 which will be addressed by Hon’ble Prime Minister of India Sh. NarendraModi. Thereafterthe District Magistrate has written a letter vide memo number 95/C dated 05.05.2019 to Principal Sainik School on the above subject requesting him to let him know the ownership status of the aforesaid ground. Principal Sainik School has verbally informed us that he has already replied to DM Purulia that the land in question was acquired by Education Department Government of West Bengal in 1963 and subsequently the right,title,interest and possession was transferred in favour of Sainik School authorities Purulia and since then it is in their possession with a valid title.  

 

We had applied on the Suvidha App for permission to use the Helipad and their ground i.e. RaiBaghini Math which is owned and possessed by Sainik School authorities. However we have received another letter from District Magistrate vide their memo no 607/PRL/SUV/PGE-2019 dated 06.05.2019 on the above subject. The letter states that the land belongs to Department of Education Government of West Bengal which has already issued a no objection certificate in favour of another party vide their memo no 609-ES/AGMN/10M Dated 06.05.2019.

 

The District Magistrate has asked us to submit necessary NOC from School Education Department Government of West Bengal which is uncalled for and unnecessary since the ground is a private property belonging to the Sainik School.

 

The State Government authorities are intentionally creating hurdles in the organisation of the Hon’ble Prime Minister’s rally. This is matter of national security as it involves the Hon’ble Prime Minister. A political party’s democratic right is also being curtailed. The matter has been brought to the notice of the General Observer of Purulia 35, Parliamentary Constituency Shri A.P.Menon (IAS).

Bankura: The DmBankura also withdrew permission on the pretext that the ground was unsuitable, even though the permission was obtained for both helipad and meeting ground and alternate land was also identified and required NOC was obtained yet the DM has forced the owner to send an objection as an after thought.

 

We beseech the Election Commission to exercise its wide superintendence powers under Article 324 of the Constitution of India and issue necessary directions / orders for granting the said permission immediately to ensure smooth holding of the Hon’ble Prime Minister’s rally on 9.5.2019.
