Memorandum : Mahayuti-BJP delegation led by Shri Arun Jaitley on Adarsh Scam

His Excellency,

Sub: To Re-Call for Governor of Maharashtra.

Ref: Adarsh Scam/Investigation & Sanction against Mr. Ashok Chavan

We are concerned about the manner in which Shri K Sankaranarayanan Governor of Maharashtra rejected CBI’s application, asking for sanction to proceed against Shri Ashok Chavan in Adarsh Scam.

Major Observations

  • Rejecting CBI application for sanction to prosecute Mr. Ashok Chavan
  • There was no proper application of mind while rejecting the sanction
  • Enough evidences against Mr. Ashok Chavan in the Patil Commission Report.
  • Commission in his report has evidently stated that there exists prima facie case.
  • That the Commission in Para 69 and thereafter has specifically stated that there was quid pro quo by Mr. Ashok Chavan
  • That the commission at Para 79 has also recommended Penal action
  • That even the Action Taken Report at Para 7 the Government of Maharashtra has recommended action for the Quid Pro Quo.
  • Maharashtra Govt. in ATR recommend action against all whose names are  mentioned in Para 69.  ATR states that as CBI has already filed FIR against 13  accused including Mr. Ashok Chavan no need for another FIR
  • The Report of the Commission was presented to the government in April 2013.
  • Only specific/convenient observations were adopted from the Report by Rajbhawan/Governor which suited to refuse sanction of Shri Ashok Chavan.
  • Knowingly the State Government/Raj Bhavan/Governor avoided the findings /strictures/recommendations of Patil Commission report as regards the quid pro quo and action against Mr.Ashok Chavan.
  • Even the PAC of Parliament on Adarsh Scam has observed connivance & corrupt practises and recommended strict actions
  • It’s on the basis of  Governors refusal to grant sanction the CBI thus approached the Special Court to delete the name of Mr. Ashok Chavan as accused

The Governor of Maharashtra failed to apply his mind in proper perspective. That the Governor even though in public interest was bound to grant sanction allowed Shri Ashok Chavan to walk away.

Under the circumstances we request Governor of Maharashtra must be re-call
