LEGAL NOTICE

 

To

Sir,

    Under instructions from and on behalf of my client Mr. Nitin Gadkari,former President of BJP, presently M.L.C Maharashtra, resident of 13 Teen Murti Lane, New Delhi-110001, I do hereby serve you with the following Legal Notice:-

1.    That my client is a senior leader of Bharatiya Janata Party, Opposition Party of India . My client is associated with this National Political Party for last several decades and is a senior leader of the party with substantial responsibility.

2.    That you, the Notice, have intentionally and deliberately made false allegations and malicious remark in public against my client which has and will damage my client’s reputation.

3.    That my client was shocked to see the news and the article published online in all leading news channels on 31.1.2014 where you have intentionally and deliberately included the name of my client Shri Nitin Gadkari and published his name in your baseless manufactured list of ‘India’s Most Corrupt’.

4.    That as a responsible Chief Minister, it is your duty to ensure that reckless and scandalous publications are not made which malign the image of a senior leader. It is evident from the tenor of the news aired and article published at your behest, that the name of my client has been deliberately highlighted even though my client has no nexus with any such incidents as alleged.

5.     That the false allegations made by you intentionally and deliberately in public against my client are derogatory and defamatory. That the disparaging remark made and spoken by you against my client are false, concocted, malicious and incorrect. The disparaging remarks made by you publicly against my client have and will lower the dignity of my client and damage my client’s reputation in the eyes of the public.

6.    That your deliberate actions of making false and malicious allegations against my client in public clearly reveal your ulterior motive for demeaning and slandering the image of Shri Nitin Gadkari.

7.   That the news circulated and published by you, the notice, is per se defamatory and scandalous. Baseless conclusions have been drawn on your part.

8.   You the notice deliberately published the aforesaid ‘List of India’s Most Corrupt’ mentioning the name of Mr. Nitin Gadkari in a grossly  irresponsible manner. Mr. Nitin Gadkari is a senior party member at the helm of one of the largest political parties and commands the respect of the public at large. He has a large following. However, you the notice, deliberately tried to malign his image even though he is not involved in any wrongful or corrupt act.

9.   That the contents of your article carry massive ramifications for Bhartiyta Janata Party. The reputation and image of senior leaders is vital for any political party. However, you the noticee deliberately and intentionally published the said news item knowing fully well and having reason to believe that such imputation will harm the reputation of Mr. Nitin Gadkari and Bhartiya Janata Party.

10.   That wild and concocted allegations mentioned in the aforesaid news article by you the notice against Mr. Nitin Gadkari made are completely defamatory, scandalous and false.

11.   That the aforesaid news article is defamatory, scandalous and false and reckless statement is being aired in various news channels and available on various forms of public domain for the people at large.

12.   You notice on 17.10.12 had also made such false and baseless allegations on corruptions against my client without any basis or proof. All those allegations have not been substantiated till date. The conduct and behavior of you notice clearly reflects that you are in the habit of maligning the reputation of my client to advance your vested political agenda and gain cheap publicity and media attention.

13.    You are hereby called upon to withdraw your defamatory and malicious remarks by publishing and publicly apologizing before all the news channels and withdrawing the name of my client from the contents of news List of India’s Most Corrupt’ within three days of receipt of this Legal Notice, failing which my client will be constrained to take appropriate legal action against you including prosecuting you for criminal defamation at your risk, cost and consequences.
